Mayor Gondek called the Meeting to order at 9:30 a.m. on 2022 November 1.

Mayor Gondek provided opening remarks and a traditional land acknowledgement.

Mayor Gondek recognized the third week of November as Metis Week as well as Louis Riel Day on 2022 November 16.

Mayor Gondek recognized General Manager Doug Morgan for receiving the Edward J. Dowling Distinguished Service Award at the Canadian Urban Transit Association Leadership Awards.

Mayor Gondek recognized the passing of John Currie on 2022 October 13.

Mayor Gondek recognized and thanked the outgoing Public Members of Boards, Commissions, and Committees for their service during the past term. 

A document entitled "Thank you for your Service - Public Members of Boards, Commissions, Committees" was distributed.

Mayor Gondek recognized the Downtown Strategy Team for receiving the Level Up - Calgary Minecraft Challenge Minister's Award for Municipal and Public Library Excellence, in the Partnership Category.

A presentation entitled "Level Up - Calgary Minecraft Challenge Minister's Award for Municipal and Public Library Excellence: Partnership Calgary" was distributed with respect to Item 3.1.

Mayor Gondek recognized the Assessment and Tax Team on being awarded the Certificate of Excellence in Assessment Administration by the International Association of Assessing Officers.

A presentation entitled "The City of Calgary - Assessment and Tax Team Awarded the Certificate of Excellence in Assessment Administration" was distributed with respect to Item 3.2.

Councillor Demong introduced a group of Grade 5 and 6 students from Lake Bonavista School (Ward 14), along with their teacher, Carla Burnham.

The Mayor provided remarks indicating that she had spoken with First Nations and Metis leaders, as well as Elders, advisors and experts from the Indigenous Relations Office about a racist video which included a Member of Council. Councillor McLean agreed to sit with a circle of Elders and report back to a public Meeting of Council with a path forward on restitution. Councillor McLean agreed to demonstrate restitution by stepping away from his involvement with a number of Boards, Committees and Commissions. All Members of Council present made a public commitment to the journey towards truth and reconciliation. 

Upon request, the City Clerk agreed to randomly draw an order by which Members of Council can participate in conducting Land Acknowledgements at future Council meetings.

Councillor Demong introduced a group of Grade 5 and 6 students from Lake Bonavista School (Ward 14), along with their teacher, Carla Burnham.

                (4)        The minimum building setback from a rear property line for a Grade-Oriented Rowhouse is 1.5 metres.

    1. That Council direct Administration to return to Council in Q2 2023 with a scoping report including:

      1. An overview of potential bylaw changes that could increase the ability of enforcement authorities to enforce laws and bylaws addressing vehicle noise;
      2. An overview of potential changes to the structure of fines and penalties related to vehicle noise that could aid in deterring vehicle noise;
      3. A workplan and budget request, including equipment, training, and staffing requests as necessary, to support the expansion of traffic stop enforcement efforts to include Calgary’s Community Peace Officers;

    2. That Council direct Administration to initiate:

      1. Discussions to acquire the relevant permissions from law enforcement and the Government of Alberta to authorize Calgary’s Community Peace Officers to perform traffic stops;
      2. Discussions with the Calgary Police Service to gauge the viability of a joint pilot campaign between Calgary’s Community Peace Officers and the Calgary Police Service regarding vehicle noise enforcement to potentially be launched in the Summer of 2023;

    3. That Council direct Administration to return to Council in Q1 2024 with:

      1. A report summarizing progress made towards improving vehicle noise enforcement;
      2. A review of automated systems being piloted in other jurisdictions, and the technical and legal viability of their applicability in Calgary.

    To address concerns about loud noise emitting vehicles and motorcycle, Council directs Administration to engage the Government of Alberta via Alberta Municipalities to research and advance legislation that restricts the sale of after-market mufflers that exceed 92 decibels.

    Pursuant to Section 100(3) of the Procedure Bylaw 35M2017, the motion was withdrawn by General Consent.

Whereas Community groups that wish to repair screening fences to maintain community aesthetics and/or continuity of fencing must first gain lawful access to enter the private property.

While the City has created a Voluntary Access Easement Agreement for Screening Fences. This is an agreement between The City and property owner that allows The City, or its agents, to access the property in the future should maintenance be needed.

Can administration advise whether or not it is possible to register on title an access agreement on private property to maintain perimeter and/or screening fences in existing developed areas without the property owner's consent.

If not, then what recourse would the City have to ensure that the perimeter fencing is maintained in a good condition. And what if anything can be done to allow for a community identification sign to be placed on that same fence?
